The petitioner seeks bail in connection with Nalanda P.S. Case No. 170 of 2017/S.T. No. 192 of 2018 for the offence under Sections 399 and 402 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by a co-ordinate Bench of this Court vide order dated 09.03.2018 passed in Cr. Misc. No. 13984 of 2018 with liberty to renew the prayer for bail six months after framing of charge. It is further submitted that the charges in this case have been framed on 18.05.2018. No.78595 of 2018(2) dt.25-01-2019 2/2 concerned, It is observed by the co-ordinate Bench vide order dated 09.05.2018 that 3 Kg Cane bomb be read as 3 gram Cane bomb which is evident from annexure-1 itself. The petitioner is rotting in custody since 4.11.2017. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-1 Nalanda, Biharsharif in connection with Nalanda P.S.
