The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 411, 413, 414 of the Indian Penal Code.

As per the prosecution case, on secret information, a raid was conducted. During raid, one stolen motorcycle has been recovered from the house of co-accused Mantu Kumar who disclosed the name of petitioner.

It is submitted that petitioner has been falsely implicated in this case. Name of petitioner transpired in this case on the basis of confessional statement of co-accused Mantu Kumar. No stolen article has been recovered from possession of this petitioner. The only material that has come against this

Patna High Court CR. MISC. No.23487 of 2023(2) dt.26-06-2023 2/2 petitioner is that stolen motorcycle was purchased by the coaccused Mantu Kumar from the petitioner three months back. Save and except confessional statement of co-accused there is no material against the petitioner.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Aurangabad in connection with Haspura P.S. Case No. 356 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
