JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This is an application for grant of anticipatory bail in connection with Guthani P.S. Case No. 13 of 2019 disclosing offences under Sections 304B, 34 of the Indian Penal Code. Petitioner happens to be the mother-in-law and the case is dowry death. Allegation is that petitioner and other accused set her on fire.

Submission of the learned counsel for the petitioner is that as a matter of fact, she was caught fire while preparing food and the aforesaid facts has come in the investigation in paragraphs 14 & 15 and also there is no specific allegation against the petitioner.

Heard learned A.P.P. as well as learned counsel for the informant also, who has opposed the prayer for bail on the ground that deceased has received 100% burn injuries and the witnesses also supported the prosecution case. However, he has

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Siwan, in connection with Guthani P.S. Case No. 13 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
