JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-05-2017 Heard counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Rupaspur P.S. Case No. 212 of 2016 for the offence under Section 341, 323, 506, 379 and 386/34 of the Indian Penal Code.
The allegation against the petitioner is that he was the member of the team, who demanded ransom from the informant. In para-3 of the petition, petitioner has mentioned that he has no criminal antecedent. From perusal of Annexure-2, it appears that he is a student preparing for competitive examination and Annexure-03 is the compromise petition filed by the informant and the petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the
Patna High Court Cr.Misc. No.19833 of 2017 (2) dt.31-05-2017 2/2 event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur, Patna or his successor Court in connection with Rupaspur P.S. Case No. 212 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
