Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Daraundha Police Station Case No. 46 of 2016, disclosing offence under Sections 341, 324, 379, 504/34 of the Indian Penal Code and Section 3 (i) (x) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act. The petitioner is alleged to have taken caste name of the informant using abusive language. It is also alleged that the petitioner assaulted him with fists and slaps and snatched from him a sum of Rs. 1000/- and a golden chain.
Patna High Court Cr.Misc. No.25278 of 2016 (3) dt.15-07-2016 2/2 Learned Counsel for the petitioner appears to be right in his submission that no offence under Section 3 (i) (x) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act is made out on the basis of what was alleged in the First Information Report.
Considering the nature of allegation of assault, this application is allowed.
Let the petitioner, Manish Kumar Singh @ Chunnu Singh, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Daraundha Police Station Case No. 46 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
