The petitioners apprehend their arrest in connection with Birpur (Balua Bazar) P.S. Case no. 06 of 2014, registered under Sections 341, 323, 379, 354, 504 and 427/34 of the Indian Penal Code. The accusation is that on 29.12.2013 at about 8.00 P.M., petitioners along with one Nabi Hussan armed with lathi and danda came at the house of informant and started abusing to her. Thereafter, informant ran away in her courtyard and locked the gate, but they forcibly entered in the house and petitioner No.2 tried to outrage the modesty of the informant. In the meantime, Nabi Hussan took a box containing cash of Rs. 5000/-. On raising alarm by the informant, Petitioner No.2 snatched ornament from her neck worth of Rs. 8000/-
Patna High Court Cr.Misc. No.8435 of 2017 (4) dt.20-06-2017 2/2 and petitioner No.1 also snatched her golden chain worth of Rs. 10,000/-. On raising alarm, villagers rushed and they fled away from there.
Learned counsel for the petitioners submits that petitioners and informant are next door neighbours and due to some dispute, the petitioners have been falsely implicated in this case. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M Birpur (Supaul) in connection with Birpur (Balua Bazar) P.S. Case No. 06 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
