JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The petitioner is not named in the first information report but from perusal of the impugned order goes to show that he was arrested and confessed his guilt. It is submitted by the learned counsel appearing for the petitioner that stolen motorcycle of the present case has not been recovered from conscious possession of the petitioner and he is in jail custody for near about six months.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.78791 of 2018(2) dt.18-01-2019 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Goreakothi P.S. Case No. 259 of 2017.
