JUSTICE ARVIND SRIVASTAVA ORAL ORDER 26-11-2021 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner no. 2, since during the pendency of this application, he has been arrested. Permission is accorded.

Hence, the application of petitioner no. 2 is dismissed as withdrawn.

Heard learned counsel for the petitioner nos. 1 and 3 and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Ahiyapur P.S. Case No. 316 of 2020 registered under Sections 307, 387, 506 and 34 of the Indian Penal Code and

Patna High Court CR. MISC. No.25180 of 2020(5) dt.26-11-2021 2/2 Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner nos. 1 and 3 submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that on perusal of first information report, it appears that specific allegation of gunshot injury to the informant is against the co-accused Abhinav. Petitioners have no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner nos. 1 and 3 be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 316 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
