JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-04-2024 The present writ petition has been filed seeking the following reliefs:- "i) For issuance of writ in the nature of certiorari for quashing the order as contained in Memo No.3747 dated 29.07.2021 issued by the Registrar, Co-operative Societies, Bihar, Patna whereby the petitioner has been suspended from the post of Co-operative Extension Officer, the then Mining Inspector, District Mining Officer, Bhojpur, Ara with immediate effect due to involvement in illegal mining of sand with the involved persons.

Patna High Court CWJC No.5901 of 2024(2) dt.25-04-2024 2/2 (ii) For issuance of writ in the nature of mandamus commanding the Respondents to revoke the suspension of the petitioner and further to make posting of the petitioner on the post of Co. operative Extension Officer at any place in Co- operative Department."

At the outset, the learned counsel for the parties are in agreement that the present case can be disposed off with a direction to the disciplinary authority to take the disciplinary proceeding, either under contemplation or pending qua the petitioner, to its logical conclusion, by passing the final order, within a period of six months from today, failing which the order of suspension dated 29.07.2021, passed by the Registrar, Co-operative Societies, Government of Bihar, Patna shall stand revoked, automatically. It is directed, accordingly. 3.

It is needless to state that the petitioner shall co-operate in the ongoing departmental proceeding. 4.

The writ petition stands disposed off on the aforesaid terms.
