1. This is an application for quashing of the order dated 09.07.2015 passed in Complaint Case No. 29054(c) of 2014 by which the learned Magistrate took cognizance for the offences under Sections 406 and 420 of the Indian Penal Code.
2. It has been submitted by the learned counsel for the petitioner that the complainant and the company i.e. M/s Supertech Limited at Noida (U.P.) have settled their dispute and pursuant to the settlement of dispute, Rs. 4 Lakhs has been paid to the complainant in Money Suit No. 111 of 2015 in the Court of Sub-Judge-I, Patna and pursuant to the same, both the parties have left pairavi in the Money Suit.
3. The office bearers of the company had filed Cr.
Patna High Court CR. MISC. No.46285 of 2015(2) dt.21-08-2023 2/2 Misc. No. 45230 of 2015 which has been allowed on 19.04.2023 and by the order dated 19.04.2023, the order dated 09.07.2015 passed by learned J.M. 1st Class, Patna in Complaint Case No. 29054(C) of 2014 has already been quashed by this Court.
4. It is clarified that order dated 09.07.2015 passed by learned J.M. 1st Class, Patna in Complaint Case No. 29054(C) of 2014 is hereby quashed with regard to all the accused persons of the cases and the matter is closed.
5. The certified copy of the Money Suit No. 111 of 2015 is taken on record.
6. This application stands allowed.
