JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-448, 323, 354(B), 379, 427, 504, 506, 509, 307 and 380/34 of the Indian Penal Code.
Petitioners are said to have assaulted the informant, having entered into her home and also made attempt to commit her murder by pressing her neck but it appears from the materials, available on the record as well as submission of the parties that there is long standing dispute between the parties and litigations between them are going on.
Learned counsel, appearing for the informant submits
Patna High Court Cr.Misc. No.26304 of 2016 (3) dt.19-07-2016 2/2 that the injuries of the informant were found grievous in nature by the doctor but he failed to disclose as to on which part of body of the informant, grievous injury was found because the concerned doctor had not mentioned the aforesaid fact in the injury report. He also, frankly, admitted that initially, the doctor found all the injuries of the informant, simple in nature but subsequently, on the basis of X-ray report, he opined that the injuries were grievous in nature.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Lakhisaarai (Kabaiya) P.S. Case No. 203 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai.
