The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324/34 of the Indian Penal Code and section 8 of the POCSO Act.

As per the prosecution case, this petitioner tried to establish physical relation with the minor daughter of the informant.

It is submitted that petitioner has been falsely implicated in this case. No such occurrence as alleged in the FIR has ever taken place. Informant is next door neighbour of petitioner and due to petty dispute, this false and fabricated case

Patna High Court CR. MISC. No.23536 of 2023(2) dt.26-06-2023 2/2 has been lodged by the informant. There is delay of 14 days in lodging of the FIR for which there is no plausible explanation. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge VI-cum-special Judge POCSO Act, Muzaffarpur in connection with (Muzaffarpur) Sadar P.S. Case No. 425 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
