JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 341, 307, 302 and 504 of the Indian Penal Code.
Allegation against the petitioner is that he along with thirteen F.I.R. named accused persons assaulted husband of the informant and two other persons with various arms, as a result of which husband of the informant had died.
It has been submitted on behalf of the petitioner that he is in custody since 30.3.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against him. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
Patna High Court Cr.Misc. No.28803 of 2016 (5) dt.30-08-2016 2/2 amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Barachatti P.S. Case no. 482 of 2015.
