JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-07-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Naya Ram Nagar (Safiya Sarai) Police Station Case No. 116 of 2015, disclosing offences under Sections 25(1-B) 25(1AA)/26(i)(ii)/35 of the Arms Act. Learned counsel for the petitioners has submitted the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has been made accused in this case merely on the basis of suspicion as the coaccused of this case has falsely disclosed the name of this petitioner. Nothing has been recovered from the possession of the petitioner. No any cogent material has come against the

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-1st, Munger in connection with Nayaram Nagar (Safia Sarai), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
