Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Riga P.S. Case No. 167 of 2019, registered for the offences punishable under Sections 341, 323, 354, 379 and 34 of the Indian Penal Code.

The informant alleged that on 07.06.2019 at about 6.30 pm, while these petitioners were cutting Sheesham logs this informant made protest upon which, these petitioners

Patna High Court CR. MISC. No.24545 of 2020(3) dt.05-11-2020 2/2 abused and assaulted her, causing fracture injury on arm. It is submitted that petitioners have been falsely implicated in this case. The Sheesham logs belong to the petitioners. Informant is niece of the petitioners. Both parties are Gotias. There is land dispute between the parties. One of the petitioners has earlier filed a petition before the Circle Officer, Riga for measurement of disputed land and a case is pending in the Civil Court Sitamarhi. Petitioners have got clean antecedent as stated in para 3 of the bail petition.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 167 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
