No doubt, petitioner is not named in the first information report but from perusal of the F.I.R as well as case diary, I find that charge sheet was submitted against the petitioner much earlier showing him as absconder.

Considering the aforesaid facts as well as submissions of the parties, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Khusrupur P.S.Case No. 03 of 2001, pending in the court of Judicial Magistrate, 1st class, Patancity stands rejected.
