====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioners and the State.
The petitioners seek bail in Buxar (M) P.S. Case No. 334 of 2018, Ex-997 of 2018, instituted for the offence under Section 30(a) of Bihar Excise Act, 2016. In the written report it is alleged that 180 bottles each containing 180 ml. of foreign liquor has been recovered from possession of the petitioners who were coming on Splendor Motorcycle. The seizure list is part of First Information Report wherein it is mentioned that recovery has been made from the road.
Counsel for the petitioners submits that petitioners are in custody since 30.10.2018 having clean antecedent.
Patna High Court Cr.Misc. No.77569 of 2018(2) dt.15-01-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.II, cumSpl. Judge of Excise Act, Buxar, in connection with Buxar (M) P.S. Case No. 334 of 2018, Ex-997 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioners.
