The petitioner apprehends his arrest in connection with Lakhnaur P.S. Case No. 26 of 2017 registered for the offence punishable under Section 7 of Essential Commodities Act. Allegedly, the petitioner and other Public Distribution System Dealers were making irregularities in distribution of kerosene oil and grains.
Submission is of false implication and that the license of the petitioner has already been cancelled, he has already suffered, there is no scope of his livelihood, without any inquiry this FIR has been lodged and as such the petitioner deserves sympathetic consideration. It is further submitted that in such type of case prearrest bail has been granted earlier in Cr. Misc. No. 53881 of 2013
Patna High Court Cr.Misc. No.26563 of 2017 (2) dt.13-07-2017 vide order dated 20.05.2014.
Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, Madhubani in connection with Lakhnaur P.S. Case No. 26 of 2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
