The petitioner seeks bail in Gogri P.S. Case No. 112/2018, instituted for offences under Section(s) 302/34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence at 2:00 A.M. informant woke up and saw the petitioner with other accused persons running away from the house of her Devar Gulo Yadav. The informant reached at the house of her Devar and found him lying dead on the ground. It is further alleged that wife of her Devar had illicit relation with accused persons.
Learned counsel for the petitioner has submitted that petitioner has clean antecedent. The other co-accused Lalta
Patna High Court Cr.Misc. No.77511 of 2018(2) dt.15-01-2019 2/2 Chaurasia has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 64354/2018 dated 20.11.2018. Petitioner is in custody since 21.06.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Khagaria in connection with Gogri P.S. Case No. 112/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
