Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks from the date of restoration of normalcy. The petitioner is apprehending his arrest in connection with Tariyani P.S. case No.165 of 2019 registered under Sections 201, 304(B)/34 of the Indian Penal Code, pending in the court of C.J.M., Sheohar.

The anticipatory bail of the petitioner was rejected vide Annexure 1 to the present application by a Co-ordinate Bench of this Court.

This is the second attempt for grant of anticipatory bail filed on behalf of the petitioner.

Patna High Court CR. MISC. No.36153 of 2021(2) dt.06-08-2021 2/2 I find no reason to interfere with the earlier order passed vide Annexure 1 to the present application. The present application for grant of anticipatory bail is dismissed.

If the petitioner surrenders before the court below and prays for regular bail, same shall be considered on its own merit without being prejudiced by this order, taking into account that the informant has already retracted from the earlier statement made in the F.I.R. and has made an application in the court below.
