JUSTICE ARUN KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with K. Nagar (Champa Nagar) P.S. Case No.97 of 2011 registered under Sections 147, 148, 149, 341, 353, 323, 325, 307 and 427 of the Indian Penal Code.

Allegation is that while the Circle Inspector went to

Patna High Court Cr.Misc. No.29183 of 2017 (2) dt.13-07-2017 2 / 2 demarcate the land in which the court had appointed Circle Officer as Receiver then all accused persons forming an unlawful assembly attacked on Circle Inspector and others causing injury to them.

Learned counsel for the petitioners submits that the allegations are general and omnibus against the petitioners. However, it appears that this case was lodged in the year 2011 and the petitioners were absconding since then. Having considered the said facts and circumstances and nature of offence, prayer for anticipatory bail on behalf of the petitioners is rejected in connection with K. Nagar (Champa Nagar) P.S. Case No.97 of 2011, pending in the court of the learned Chief Judicial Magistrate, Purnea.
