JUSTICE SUDHIR SINGH ORAL ORDER 29-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 379, 411, 413, 414, 468 and 471 of the Indian Penal Code and Sections 25(1-b) a, 26 and 35 of the Arms Act. Allegation against the petitioner is that one stolen motorcycle was recovered from his possession. It has been submitted on behalf of the petitioner that he is in custody since 3.4.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has not been apprehended on the spot. Name of the petitioner has been disclosed by the coaccused.

One stolen motorcycle is alleged to have been recovered from the possession of the petitioner. Petitioner had no knowledge that the said motorcycle is a stolen property. Other co-accused have been granted bail vide Cr. Misc. no. 23904 of 2016, Cr. Misc. no. 33985 of 2016 and Cr. Misc. no. 26192 of 2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.26869 of 2016 (3) dt.29-08-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case no. 110 of 2016.
