JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2019 Learned counsel for the petitioners submits that petitioner no.1 has been arrested and as such, he does not want to press this bail application on behalf of petitioner no.1. In such view of the matter, this bail application is dismissed as not pressed against petitioner no.1. In this case, the petitioner no.2 is seeking anticipatory bail in connection with Atri P.S. Case No. 365 of 2018, registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and under Sections 30(a) (d) of the Bihar Prohibition and Excise Act, 2016. Allegation has been made that 5 liter of Mahua liquor has been recovered from the house of the petitioner no.2. The petitioner has criminal antecedent. Hence, this
Patna High Court Cr.Misc. No.80734 of 2018(2) dt.25-01-2019 2/2 Court is not inclined to grant bail to the petitioner no.2. Accordingly, the prayer for bail is rejected. However, if the petitioner no.2 surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
