14-07-2016 Heard Sri Rajeev Ranjan No. II, learned counsel for the petitioner and Smt. Pushpa Sinha, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 23-11-2015 in Baligaon P.S. Case No. 38 of 2015 registered for the offence under Sections 147, 148, 149, 435, 427, 387, 506 of the Indian Penal Code, Section 27 of the Arms Act, 1959 and Section 17 of Criminal Law (Amendment) Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that F.I.R. was lodged against unknown, however; during investigation, one of the accused namely Pramod Paswan was arrested and on his confession, name of petitioner was disclosed
Patna High Court Cr.Misc. No.26925 of 2016 (2) dt.14-07-2016 2/2 and thereafter, the petitioner was made accused in the present case. By way of referring to Annexure - 2 to the petition, learned counsel for the petitioner submits that co-accused Pramod Paswan has already been granted bail by this Court on 21-04-2016, vide Cr. Misc. No. 13670 of 2016.
Keeping in view the fact that accused, on whose confession petitioner was implicated, has already been granted bail, there is no reason to further detain the petitioner in custody. Accordingly, let the petitioner namely Chandan Kumar @ Chhota Chandan be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XII, Vaishali at Hajipur in connection with Baligaon P.S. Case No. 38 of 2015. (Rakesh Kumar, J.) Anay U T
