Heard the parties in virtual Court.
Petitioner seeks bail in a case registered for the offences punishable under Sections 341,323,504,506 and 34 of the Indian Penal Code, later on Sections 302 and 325 of the Indian Penal was added.
It is evident that for land dispute, two persons Vikash Yadav and the petitioner allegedly caused injury with Lathi at the head of the father and brother of the informant, as a result whereof, father of the informant died.
Submission is that the petitioner is in custody since 05.11.2018. Co-accused-Vikash Yadav has already been allowed bail by a Coordinate Bench of this Court.
Patna High Court CR. MISC. No.32979 of 2021(2) dt.07-07-2021 2/2 In the past, prayer for bail of the petitioner was refused on 29.04.2019 vide order at Annexure-1, however, the trial is still pending.
Considering period already undergone by the petitioner and grant of bail to similarly situated co-accusedVikash Yadav, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.04 of 2019/182 of 2019(S.J.) arising out of Tankuppa Police Station Case No.92 of 2018 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
