This application for regular bail arises out of Ghorasahan (Jhorakhar) P.S. Case No. 43 of 2020, disclosing offences punishable under Section 414 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act. It is stated in paragraph 3 of the application that the petitioners have no criminal antecedent and allegedly both of them were apprehended together while riding a motorcycle carrying 63.90 illicit Nepali liquor. The petitioner is in custody since 06.02.2020.

Considering the fact that the petitioner is in custody since 06.02.2020 and presuming that the charge sheet in the

Patna High Court CR. MISC. No.21445 of 2020(2) dt.02-07-2020 2/2 meanwhile, must have been submitted, this application is allowed.

Let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, East Champaran, Motihari in connection with Ghorasahan (Jhorakhar) P.S.
