Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 307, 506 and 302 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of killing father of the informant due to land dispute.

It has been submitted on behalf of the petitioner that he is in custody since 4.12.2015. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. There is admitted land dispute between the parties. He has falsely been implicated in the present case. Informant is not the eye witness to the alleged occurrence.

On behalf of the State, it is submitted that petitioner is named in the F.I.R. It is alleged that petitioner had fired on the chest of the deceased and the deceased succumbed to the said injury. Post mortem examination report also corroborates the

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. The trial court is directed to expedite the trial of the petitioner in connection with Punpun P.S. Case no. 269 of 2015. (Sudhir Singh, J) sudip/- U T
