JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends her arrest in connection with Sandesh P.S. Case No.51 of 2016 registered under Sections 363, 366(A) and 120(B)/34 of the Indian Penal Code. Allegation is that the petitioner and others kidnapped the 13 years old daughter of the informant for the purpose of marriage.

Submission is that the petitioner is the own aunt of the girl and only after 3-4 days, she returned back and her statement was recorded under Section 164 Cr.P.C. in which she has stated that she had gone with this petitioner to her relative and there is no any allegation of doing any wrong with her and this petitioner has got no criminal antecedent.

No.30236 of 2017 (2) dt.06-07-2017 2 / 2 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Sandesh P.S. Case No.51 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
