JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Petitioner is not named in the first information report but it appears from perusal of the impugned order that after institution of the present case, petitioner was caught with stolen motorcycle of the present case for which Rupaspur P.S.Case No. 288 of 2018 was registered for the offence punishable under section 399, 402 and 414 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. It is submitted that petitioner remained in jail custody in connection with Rupaspur P.S.Case No. 228 of 2018 for near about seven

Patna High Court Cr.Misc. No.78807 of 2018(2) dt.18-01-2019 2/2 months and in the present case, he was remanded on 13.07.2018 and since then he is in jail custody.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrat-XII, Patna in connection with Patliputra P.S. Case No. 223 of 2018.
