JUSTICE ANIL KUMAR SINHA ORAL ORDER 30-06-2020 Heard Mr. Madan Mohan, learned counsel for the petitioner and Mr. Narsingh Tanti, learned Additional Public Prosecutor appearing for the State through video conferencing. Learned counsel for the petitioner is directed to remove the defects within eight weeks.

Petitioner seeks regular bail in connection with Industrial Area P.S. Case No. 101 of 2019 registered for the offence punishable under Section 341, 323, 307, 504/34 of the Indian Penal Code 1860 and Section 27 of the Arms Act. The allegation against the petitioner is that he fired upon the informant which hit the right knee of the informant. Learned counsel for the petitioner submits that there is a dispute regarding mango orchard between the parties. Learned

Patna High Court CR. MISC. No.21279 of 2020(2) dt.30-06-2020 2/2 counsel further submits that petitioner has got no criminal antecedent and there is two days delay in lodging the present F.I.R. Learned counsel referring to Annexure- 2 to this bail application submits that injuries caused to the informant are simple in nature.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent, injuries caused to the informant have been found to be simple in nature and petitioner is in custody since 18.03.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Industrial Area P.S. Case No. 101 of 2019. It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
