JUSTICE SATYAVRAT VERMA ORAL ORDER 10-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Gaya Mufassil P.S. Case No. 331 of 2016 instituted for the offences under Sections 341, 323, 377, 307/34 and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 12.02.2021, is a person with clean antecedent and charge-sheet has been submitted in this case. Allegation is of snatching Rs.5,000/- and motorcycle of the son of the informant near village Ganjash while his son was going to his in-laws house and the motorcycle was hidden in the house of Rameshwar Yadav. Further during course of treatment,

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case when the deceased died on account of accident in which both son of the informant and petitioner were injured and the petitioner was taken to the nursing home of Dr. Munna Kumar and the motorcycle of the informant's son was parked by the Chaukidar near the house of Ramesh Yadav the petitioner. It is further submitted that even witnesses, during course of investigation, have supported that there was an accident in which both sides got injured. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 12.02.2021, charge-sheet has been submitted in this case and the petitioner is a person with clean antecedent let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Mufassil P.S. Case No. 331 of 2016.
