JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Paharpur P.S. Case No.22 of 2019, disclosing offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a) (b) (c), 33, 34 & 36 of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 420 liters of spirit from the house of the petitioner.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case, having no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides, in view of the allegation and the huge quantity of spirit recovered from the house of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to
Patna High Court CR. MISC. No.20920 of 2019(3) dt.19-06-2019 2/2 surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned trial court without being prejudiced by order of this Court, if possible to be disposed of on the same day.
