JUSTICE RAVI RANJAN ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 413 and 414/34 of the Indian Penal Code.
It is contended on behalf of the petitioner that, being in custody in connection with Motipur P.S. Case No. 286 of 2015, he was remanded in this matter also on 20.11.2015 on the basis of the confessional statement made by a co-accused. It is further contended there is no recovery from the possession of the petitioner. However, the petitioner has not been granted bail in Motipur P.S. Case No. 286 of 2015.
Having regard to the facts and circumstances of the case, the petitioner, namely, Manish Kumar Sharma is directed
Patna High Court Cr.Misc. No.26653 of 2016 (2) dt.15-07-2016 2/2 to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Brahampura P.S. Case No. 261 of 2015 with a further condition that one of the bailors of the petitioner must be his father.
