Petitioner seeks bail in connection Naubatpur P.S. Case no. 378 of 2020 registered for the offence punishable under sections 8/20(b)(ii)( C ) and 22 of the NDPS Act. Learned senior counsel for the petitioner submits that petitioner is in custody since 20.07.2020 and charge sheet has been submitted. Learned senior counsel for the petitioner further submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that from this petitioner 5.7 kg Ganja was recovered apart from recovery from other accused. Learned senior counsel for the petitioner next submits that petitioner has been falsely implicated in this case

Patna High Court CR. MISC. No.32822 of 2021(2) dt.29-11-2021 2/2 and even assuming for the present the allegation to be true, alleged recovery is less than commercial quantity and little more than small quantity.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge XVI, Patna in Special Case no. 105 of 2020 arising out of Naubatpur P.S. Case no. 378 of 2020 with condition that one of the bailers would be his father and further if petitioner after commencement of trial does not appear on two consecutive dates, the learned court below shall proceed to cancel his bail bond.
