Petitioner is accused in connection with S. Tr. No. 18 of 2016 arising out of Sheikhopur Sarai P.S. Case No. 83 of 2015 registered under Sections 395 and 397 of the I.P.C. The accusation is of snatching of motorcycle and cash of the informant by 6 persons boarded on the two motorcycles.
Submission of learned counsel for the petitioner is that petitioner is not named in the F.I.R. In course of investigation, one Md. Iquabal was apprehended by the Police, who confessed his guilt and also named this petitioner, having hand in the occurrence. Except the confessional statement, there is nothing
Patna High Court Cr.Misc. No.27649 of 2016 (2) dt.11-07-2016 2/2 against the petitioner to show his involvement. Further submission is that the petitioner is in custody since 28.11.2015 in the present case, but the petitioner has not been put on Test Identification Parade, while the informant has given the physique of the culprits and also claimed to identify them.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Sheikhpura in connection with Sessions Trial No. 18 of 2016 arising out of Sheikhopur Sarai P.S. Case No. 83 of 2015.
