JUSTICE SUDHIR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 457 and 380 of the I.P.C. The prosecution story, in brief, is that the informant used to reside on rent at Mohanpur, Jamalpur in the house of Shambhu Mandal and adjacent to the said house his brother-inlaw Ram Kishore Singh is residing in his own house. Some days before Ram Kishore Singh had gone to Bombay for treatment of his wife. In the morning of 15.1.2016 he saw several persons are assembled near the house of his brother-in-law and saw that lock of grill of his house is open. Thereafer he went inside the house and found three godrej almirah were open and all the articles were scattered there. The informant informed the Police Station, upon
Patna High Court Cr.Misc. No.32561 of 2016 (4) dt.17-09-2016 2/2 which the police arrived and inquired into the matter. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.1.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Except for the self confession of the petitioner before the police there is no other material to suggest the implication of the petitioner in the present case. The petitioner was put on Test Identification Parade, but the informant did not turn up.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Munger in connection with Jamalpur P.S. case No.15 of 2016.
