JUSTICE SUDHIR SINGH ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363, 366A, 504, 341 and 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping daughter of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 2.3.2016. Chargesheet has been submitted against the petitioner. There is no allegation of tampering of witnesses against the petitioner. There was admitted love affair between the petitioner and the victim. The victim has been examined under Section 164 of the Code of Criminal Procedure where she has stated that she had left with the petitioner and subsequently when they learnt that a case has been instituted then they had returned. In her statement, there is no allegation of sexual abuse or physical assault against the petitioner. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.25783 of 2016 (5) dt.11-08-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Barh, in connection with Mokama P.S. Case no. 39 of 2016.
