The petitioners apprehend their arrest in Narpatganj P.S. Case No.741 of 2018 registered under Sections 325, 307, 354B and other minor sections of the Indian Penal Code. The informant named the petitioners and others and alleged that the accused persons having armed with different weapons suddenly attacked on the informant and his family members. The naked wires with electric current were laid on the way and the accused persons made indiscriminate firing and assaulted the informant and others with iron rod, farsa and lathi. Learned counsel for the petitioners submits that there is case and counter case. Narpatganj P.S. Case No.740 of 2018

Patna High Court CR. MISC. No.22176 of 2019(2) dt.08-04-2019 2/2 is registered on behalf of the petitioners in which Murari Sharma is informant. The informant himself disclosed that on account of land dispute the occurrence took place. From perusal of the injury report annexed as Annexure 3 series, it would appear that Shambhu Sharma (informant) did not receive any injury. The other persons got superficial and simple injury.

Having considered the facts that there is case and counter case and the occurrence took place due to land dispute and the informant and other persons from the side of informant got superficial and simple injury, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Narpatganj P.S. Case No.741 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
