The petitioner seeks bail in a case registered under Section 188 of the Indian Penal Code and Section 47(A) of the Excise Act.
It is contended that alleged recovery of 750 ml. of foreign liquor was from the other person who was sitting on the motorcycle, namely, Vivek Ranjan. It is further contended that the petitioner is in custody since 28.04.2016. Petitioner claims to have a clean antecedent.
Having regard to the facts and the circumstances of the case, the petitioner, Pawan Kumar Jha, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees
Patna High Court Cr.Misc. No.26595 of 2016 (2) dt.12-07-2016 2 / 2 Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Vth, Bhagalpur in connection with Sanhaulla P.S. Case No.51 of 2016.
