2. At the outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application on behalf of Petitioner No. 1, namely Sonu Kumar, as during pendency of this case, Petitioner No. 1 has already been arrested.
3. Permission, as prayed for, is accorded.
4. Accordingly, this anticipatory bail application on behalf of Petitioner No. 1 stands dismissed as withdrawn.
5. Petitioner No. 2 apprehends his arrest in a case registered for the offence punishable under Sections 191(2),
Patna High Court CR. MISC. No.24280 of 2025(2) dt.01-05-2025 2/2 190, 126(2), 115(2), 109, 135, 121(1), 121(2), 317(4) and 317(5) of the B.N.S..
6. As per prosecution case, it is alleged that on secret information that this petitioner, along with other accused persons, is unloading liquor and banned cough syrup from stolen alto vehicle, a raid was conducted and it is alleged that all the accused persons, including this petitioner, abused and assaulted police party and thus, created hindrance in discharge of their official duties. Petitioner No. 2 has got one criminal antecedent.
7. Considering the nature of accusation and criminal antecedent of the petitioner, the prayer for grant of anticipatory bail to Petitioner No. 2 is rejected.
