JUSTICE SUDHIR SINGH ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 376 and 511/34 of the Indian Penal Code and 3 (i) (xi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act and Section 8 and 10 of the POSCO Act. Allegation against the petitioner is that he along with another accused tried to molest daughter of the informant and on protest by the father of the victim, he was also abused and insulted.

It has been submitted on behalf of the petitioner that he is in custody since 2.4.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has falsely been implicated in the present case. From perusal of Annexure-2 it is evident that prior to the institution of the present case there was admitted dispute between the parties. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I cum Special Judge, West Champaran at Bettiah, in connection with Manjhaulia P.S.
