Petitioner seeks bail in Sessions Trial No.249 of 2018 arising out of Hussainganj P.S. Case No. 356 of 2017 instituted for the offence under Section(s) 302, 120(B) Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that petitioner is not named in the First Information Report. Name of the petitioner has figured during investigation in the confessional statement of Wajir Ahmad.
In the written report, it is alleged that informant got information that his father is lying on the western side of road situated at Judakan Tola near Toppers Coaching Center. The informant reached there along with others and took his father to
Patna High Court Cr.Misc. No.79964 of 2018(2) dt.17-01-2019 2/2 hospital where he was declared dead.
Petitioner is said to be in custody since 24.02.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 4th Additional Sessions Judge, Siwan, in connection with Sessions Trial No.249 of 2018 arising out of Hussainganj P.S. Case No. 356 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
