The petitioner apprehends his arrest in connection with Parsa Bazar P. S. Case No. 219 of 2016 instituted under Sections 307, 323, 325, 341 and 504 of the Indian Penal Code. The allegation, in brief, is that when the informant asked from the petitioner to return back his Rs. 7,000/-, which was returned back by him but started abusing him then informant retorted, the petitioner assaulted on his head with broken bottle of glass causing injury on his head.
It is submitted that the petitioner accidentally sustained injury by fall from the motorcycle and he has filed a injury report issued by a private nursing home which also shows that injury is accidental and the injury is simple in nature and the
Patna High Court Cr.Misc. No.29145 of 2017 (2) dt.13-07-2017 2/2 petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Raju Kumar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Gayatri Kumari, J.M 1st Class, Patna in connection with Parsa Bazar P.S.Case No. 219 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
