Petitioner seeks bail in connection with Special Case No. 1649 of 2017, arising out of Bakhtiyarpur P.S. Case No. 99 of 2017 for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel, is that on secret information that the petitioner has concealed illicit liquor in a semi-constructed primary school, the police conducted a raid and under the stairs of the said school recovered 20 litres of country-made liquor. Accordingly, a seizure-list was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history, nothing

Patna High Court CR. MISC. No.20951 of 2019(2) dt.04-04-2019 2/2 has been recovered from his conscious possession and he was not apprehended by the police on raid. He further submits that petitioner has been sufficiently punished and he is languishing in judicial custody since 13.02.2019.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna, in connection with Special Case No. 1649 of 2017, arising out of Bakhtiyarpur P.S. Case No. 99 of 2017.
