Mr. B.N. Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-08-2020 Heard Mr. Nityanand, the learned counsel appearing on behalf of the petitioners and Mr. B.N. Pandey, the learned Additional Public Prosecutor.

The petitioners seek bail in Vaishali P.S. Case No.81 of 2020, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The gist of the allegation is that the informant got information that huge quantity of liquor and spirit were kept concealed in a field situated near the house of Harendra Paswan @ Tunni Paswan, the co-accused, and on such, the raid was conducted. From the field of Ramnath Rai and Dilip Rai liquor and spirit were recovered. Nothing has been recovered from

Patna High Court CR. MISC. No.22032 of 2020(2) dt.07-08-2020 2/2 possession of the petitioners. Petitioner No.1, Satrudhan Kumar is in jail since 19.04.2020 and Petitioner No.2 is in jail since 03.04.2020.

The learned Additional P.P. however, opposed the prayer for bail.

Having considered the facts that nothing has been recovered from conscious possession of the petitioners or from the house of the petitioners and for that the petitioners are in jail for more than three months, petitioners, namely, Satrudhan Kumar and Pawan Kumar are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Vaishali P.S. Case No.81 of 2020.
