13-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in relation to Laxmipur P.S. Case No. 48 of 2016 registered under Sections 147, 148, 149, 302, 307 and 364 of the Indian Penal Code, pending before learned Judicial Magistrate, 1st Class, Jamui.
Petitioner is one of the accused named in the First Information Report and there are allegations against him. It appears that the co-accused have earlier surrendered and got regular bail.
Considering the facts and circumstances of this case, I am not inclined to grant anticipatory bail to the petitioner.
Patna High Court Cr.Misc. No.31646 of 2017 (2) dt.13-07-2017 Accordingly, prayer for Anticipatory Bail of the petitioner is rejected.
Let the petitioner surrender before the court below and seek regular bail, the same shall be considered on its own merit.
