Heard learned counsel for the petitioner as well as learned APP for the State.

Learned counsel for the petitioner has submitted that due to typographical mistake in the address of the petitioner in the petition it has wrongly been typed as district Jamui in place of district Bhagalpur.

Accordingly, in the petition, in place of district Jamui, it shall be read as district Bhagalpur.

The petitioner apprehends his arrest in connection with Jamui P.S. Case No. 70 of 2021, registered for the offences

Patna High Court CR. MISC. No.33620 of 2021(2) dt.06-04-2022 2/3 punishable under Sections 420, 409, 379, 120 B of the Indian Penal Code and 66(c), (d) of I.T. Act, 2000.

As per allegation, the question papers of social science of Bihar Matriculation Examination, 2021 were entrusted to State Bank of India and were kept in the Bank. These question papers became viral. The informant who is District Education Officer went to the Bank and found that one packet of question paper after breaking the seals was made viral through the electronic device. These question papers, as per FIR, were entrusted to three officers including the petitioner for on time delivery with the help of one employee namely Vikash Kumar.

Learned counsel for the petitioner has submitted that the entire allegation is false. By drawing my attention towards Annexure-3, he has submitted that the petitioner was in Bhagalpur on the day of the occurrence in relation to verification of currency chest. He has submitted further two named accused persons namely Mr. Shashikant Chaudhary, Mr. Ajit Kumar have been granted anticipatory bail by the learned ADJ-3 Jamui and coaccused Vikas Kumar has been granted regular bail by the coordinate Bench of this Court in Cr. Misc. No. 31725 of 2021. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be

Case No. 70 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
