JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 01-02-2022 Heard learned Counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant, through Video Conferencing. This application, for grant of anticipatory bail, arises out of Kamtaul Police Station Case No. 238 of 2020, disclosing offences under Sections 147, 148, 149, 341, 324, 307, 379, 354, 504, 506 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that both the parties are agnates and there is previous land dispute between both the parties. He has also submitted that the informant is aunt of the petitioner.
The learned counsel for the informant has submitted that there is specific allegation against the present petitioner that

Learned Addl. P.P. has opposed the prayer for bail. Considering the aforementioned fact and circumstances including the relations between both the parties and also considering that injuries sustained by the informant is simple in nature, let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Darbhanga, in connection with Kamtaul Police Station Case No. 238 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
