JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 120(B) and 420 of the Indian Penal Code. It is alleged by the informant that the petitioner cheated the money for service of Anganbari Supervisor, Teacher and Workers Training.

It is submitted on behalf of the petitioner that the petitioner is in custody since 10.04.2016. Charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The allegation made in the FIR is denied by the petitioner. It is further submitted that the petitioner is ready to deposit an amount of Rs. 20,000/- (twenty

Patna High Court Cr.Misc. No.25660 of 2016 (3) dt.16-08-2016 2/2 thousand) in the court below, which shall be subject to final disposal of the case.

On behalf of the State it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, the petitioner is directed to deposit an amount of Rs. 20,000/- (twenty thousand) in the court below which shall be subject to final disposal of the case.

Let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., II, Jamui in connection with Sikandra P.S.Case No. 51 of 2016.
