The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Sections 420, 467, 468, 471, 120(B), 196, 197, 198, 199 & 201 of the Indian Penal Code.
Prosecution case is about an enquiry initiated by the Investigating Officer, Vigilance Investigation Bureau, Patna on the basis of a letter of the Bihar School Examination Board, Patna against the petitioner for his appointment as a teacher of Primary School, Patahulwa on the forged certificate produced by him, which is of another person.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not been apprehended at
Patna High Court CR. MISC. No.33211 of 2021(2) dt.02-03-2022 2/2 the spot. He further submits that at the time of his appointment, entire documents were verified by the appointing authority and prepared merit list and thereafter, he has been duly appointed as a Primary teacher. He further submits that he has been dismissed from the service on the ground of tampering of certificate. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 489 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
